Today’s Post is by Lori Woodward Simons ,
Regular contributing writer for FineArtViews. A special shout-out to
our good friend, Mark Saenger , for making
us aware of this situation.

Dear Artists,

There is illegal activity going on right under our noses — in which we
have sometimes unknowingly taken part. I write today’s blog not only to
make artists aware that there are pirates in the industry, but also to
rally support for the artists’ whose work I love.

Lately, there’s been a rash of artist instructional DVD sales on Ebay.
The sad part is that these DVDs are often illegal copies and are sold at
amazingly inexpensive prices (by auction). Recently, I’ve been
discussing this problem with artists who produce instructional DVDs, as
well as, companies that film and distribute videos. Here’s what Ralph
Lilidahl, manager of Lilipubs shared with me on the subject.

“I think the most compelling argument is that artists have worked long
and hard to achieve their present status, and so deserve to be
compensated for each and every ‘performance’ (Playing of the DVD). When
illegal copies are purchased on Ebay or Craigslist, the artist receives
NO residual royalty for their performance, but additionally, that sale
provides no return to us (Lilipubs) for our advertising costs.”

Instructional videos cost an artist tens of thousands of dollars to
produce. For example, I know one artist who paid $60,000 for the first
video he produced. Not only is the production of the video costly, but
the advertising in order to get the word out can be tremendously
expensive. Dear artists, let’s make it our mission to avoid messing with
bootlegged copies.

How to tell if it’s an
Illegal, bootlegged copy

Most of the legal, manufactured DVDs on the market are produced by
replicating… which means the information is pressed onto the DVD
surface. These have a serial numbers pressed right onto the DVD.While
these legal copies are silver on the play side, non-replicated, copied
productions are purple. Lilipubs does produce some of their DVDs on
recordable disks though - if they expect the number of sales to be low,
so the purple is not always an indicator of a pirated copy. However,
this lets us artists know that if it is purple, it’s definitely produced
by copying and not replication (pressed). Additionally, if the price is
cheap, that should be a red flag.

Signs that the Seller is
involved in Illegal activity

1. The seller offers the same disks over and over for an incredibly low
price.
If these are not illegal, how would he or she make any money? The one’s
I’ve seen on Ebay are being sold for under $20/each, and the originals
are $75 or more. These prices are too good to be true! For example.
Look up: Richard Schmid under DVDs on Ebay, and take a look at what the
current bids are: The quality says “Like New”. This seller has only been
in business since October 31st. Hmmmmm……. let me see, could this
guy be legit or is he a crook? You decide.

2. The listing does not state “Factory Original”.
It might say “similar” or “Like New”. Like new means it hasn’t been
used, but it is generally not from the factory.

3. The seller is brand new: and has a list of highly desirable videos.
When these sellers get thrown off of Ebay, they return under another
name.

4. Seller does not have a great deal of feedback, or feedback is
private.

Pirates are getting tricky. If they say “Same cover as Stock photo”,
“may vary from cover pictured”, or he or she skirts around your
questions about whether the product is a factory original, stay away.

The most obvious way to avoid being part of this scam and honor the
artists who’ve spent $$$$$ producing their videos… is to buy directly
from that artist or the publishing company that produced the DVD. Expect
to Pay Full Price. We owe it to them. If we, the community of artists,
do our part … my personal friends, Richard Schmid, Nancy Guzik, Tony
Pro, Casey Baugh, and Jeremy Lipking may be able to avoid paying
additional stiff legal fees. By working en-masse, we have the power to
get this done.

So I urge you to avoid getting caught up in this scam — buy directly
from the artist or the publishing company. There is power in numbers!
Please join me in this effort to put these crooks out of business.

Editors Note: Artists are constantly writing us to complain about
copyright violations. Much of the artist community is worried about the
orphaned works act, fearing it takes away their copyright protections.
Of course artists want and deserve good copyright protections, yet it
appears that some artists either naively or otherwise, are buying
illegal DVDs and trampling upon the copyrights of their fellow artists.
Please don’t participate! You certainly wouldn’t want your copyrights
trampled upon! As Lori wrote, let’s all work together to put these
crooks out of business. In the meantime, learn more about how you can
protect yourself and your artwork. Don’t Get Ripped Off! The business

many artists are actually operating under several myths that just won’t
seem to go away. Polish up your understanding of how copyright laws

Reading Deber’s article, I nodded in confirmation. I *always* carry a
camera, as those fleeting moments are so — well, fleeting, flying,
fleeing. There, and then gone, forever. (Usually not brutally chopped
down, though. That was really unlucky.)

If I don’t expect to see something I need to photograph, I only carry my
cellphone/mobile phone. It has a camera that will do in a pinch.
Otherwise, my extra deep purse has room for a nice little digital wonder
that has 12 x optical zoom. Larger than the ordinary digital, but not as
huge as a real camera with a real lens.

Many precious paintings have come to me through this habit of carrying a
camera all the time. Did you know it takes about a month of conscious
‘work’ to establish a habit? After that, the habit will work *for* you.
It’ll *do* the job — with a little help from you, of course.

Economic Slow Down Hits Art Market - Bacon Fails to Sell At Christie’s Auction

NEW YORK.- Christie’s Evening Sale of Post-War and Contemporary Art totaled $114 million, with 68% sold by lot. New world auction records were set for six artists, including Joseph Cornell, Yayoi Kusama, Robert Irwin, and Paul McCarthy, and for works on paper by Tom Wesselmann and Agnes Martin. Buyers were 59% American, 18% European, and 24% other.

Dear malarstwo.org,

Yesterday, I received an email from Bill Brown:

“Am Bill i want to know if u carry Painting For Sale? if i have not
mention the size can tell me one u have now ready to sell? Any model
is good with me. What is the price of one so i can purchase? Best
Regard, Bill.”

Bill seems like a nice guy, don’t you think? The kind of guy who has
confidence in the quality of an artist’s work. It really appealed to
me that he was willing to accept “any model.” The world needs decisive
buyers like Bill Brown.

It looked to me like English was not Bill’s first language, which was
fine. I wrote him back: “Please clarify what it is you want and how
much you want to spend.” I needed to clear up the money thing right
away–it sounded like money might be a language Bill understood.

Bill wrote back: “Would me buy $7000 model, but need to send $10,000
for shipping so u can return me $3000 cheque from u okay???”

“Why don’t I just tuck $3000 cash into the back of the painting?” I
wrote. “Okay,” he wrote back. “Can u send painting BY AIR right away???
i NEED IT here now.” This guy was eager, a real art enthusiast. The
parcel was to go to a post box in Shanghai. Odd, in a way, because
people can buy all kinds of paintings just like mine in China for less
than ten dollars or two for fifteen. I was getting suspicious. Was it
possible that Bill Brown was an alias for some person with another name?
Do you think his cheque for $10,000 that he promised to send might turn
out to be bogus? Could it be that someone was trying to shanghai me?
Pacing back and forth in anxiety, I walked into the end of a door.

When I regained consciousness, I saw clearly that my assistant had not
yet wrapped the painting nor had she tucked in the cash. I was quite
relieved and went to the mailbox to see if any of the grant money I’d
forgotten to apply for had come in. It hadn’t. Then I went down to the
end of the property and ate some more magic mushrooms. They’re in season
right now.

Esoterica: It’s called “The Nigerian Scam” because it started in Nigeria.

didn’t fool me.
